EHCP timeline

If you request a new EHC plan the whole process must take no more than 20 weeks, although there are some circumstances where this could be longer – parents/carers should be informed if this is the case.

  • Exceptional circumstances that can prolong the process:
  • The child or young person is away from the area for four weeks or more
  • Exceptional personal circumstances affect the child or young person and their parent.
  • The school/setting is closed for four weeks or more (this may delay the information needed being sent.)

The process that must be followed for assessment is described in The Special Educational Needs and Disability Regulations 2014

Week 0
  • Request for EHC needs assessment is received by the Local Authority (LA).
By Week 6
  • LA must decide whether to carry out an EHC needs assessment through the Education Panel.
  • Decision must be communicated to parents or the young person.
Weeks 6-16

If assessment is agreed:

  • LA must seek advice and information from:
    • Parents or young person
    • Educational setting
    • Educational psychologist
    • Health professionals
    • Social care
    • Any other relevant professionals
  • All advice must be returned within 6 weeks of request.
  • The Education Panel will make a decision to issue an EHCP or not.

If the decision is made to issue EHCP:

  • Draft EHCP written
  • Draft sent to parents and professionals
Week 16-18
  • Parents/young person have 15 calendar days to:
    • Comment on the draft plan
    • Request a particular school or setting
Week 18-20
  • LA must consult with the requested school/setting.
  • Final EHCP must be issued by Week 20.
